Instant Cash Loans Ltd t/a The Money Shop, an FCA-regulated payday lender.
ISSUES
Instant Cash Loans Ltd (trading as The Money Shop), an FCA-regulated payday lender, faced significant financial and regulatory challenges following Financial Ombudsman Service decisions requiring substantial consumer redress. As a result, the company entered into a Scheme of Arrangement (with Interpath as the scheme administrators), to manage creditor claims. A key requirement was to subsequently place the company into Members’ Voluntary Liquidation (MVL) to support the orderly wind-down of the business and facilitate the completion of the Scheme.
There were non-core loan portfolio assets to sell, all the while maintaining clear and consistent communication with a wide range of stakeholders, including creditors and borrowers, particularly those whose claims were unsuccessful under the scheme.
ACTIONS
We were appointed as Liquidator and worked closely with the directors and scheme administrators to deliver a structured and compliant wind-down of the company and a successful conclusion of the Scheme of Arrangement.
Over a four-year period, we worked alongside the directors to oversee the disposal of non-core elements of the loan portfolio, ensuring this was carried out efficiently and in line with regulatory expectations. We also supported ongoing communications with Scheme creditors, providing updates and maintaining transparency, while managing interactions with borrowers whose claims had not been upheld.
Throughout the engagement, we ensured compliance with FCA guidance and worked with stakeholders, maintaining a focus on efficiency, transparency, and cost control.
OUTCOME
The liquidation was successfully completed on a solvent basis and the scheme concluded effectively. This supported the delivery of a return of approximately 4p in the pound to creditors. The process resulted in an orderly and compliant wind-down of the business, with strong collaboration between the directors, Scheme Administrators, and the Menzies case team ensuring a transparent and cost-effective outcome for all parties involved.
