Insolvency practitioners often have no prior knowledge of the history and circumstances and have to gather information from numerous sources, which in itself can take a significant amount of time depending on the level of co-operation from third parties. A court process may be needed to obtain information and documents.

Impact of Court Proceedings and Enforcement

If proceedings are required to pursue a claim through the courts, the time taken will depend on court availability, partially driven by the size and complexity of the case. Once proceedings are completed, that may not be the end, and it may be necessary to enforce a judgment, which could again need court involvement. If a settlement is agreed instead, the timing of recoveries will be determined by the terms of the settlement agreement.
